I am writing to tell you about some breaking news of grave importance to the ACLU. Because it is going to be a big battle -- with fundamental principles at stake -- I wanted you to be the first to hear about it.
This week, the ACLU asked a federal judge to quash a grand jury subpoena that demands that the ACLU turn over to the FBI “any and all copies” of a December 2005 government document in our possession.
The three-and-a-half page document, issued in December 2005, is marked "Secret" and apparently is classified. We received the document, unsolicited, on October 23, 2006.
This attempt by the Bush Administration to suppress information using the grand jury process is truly chilling and is unprecedented in law and in our history as an organization. The subpoena serves no legitimate investigative purpose and tramples on fundamental First Amendment rights. We recognize this maneuver for what it is: a patent attempt to intimidate and impede the work of human rights advocates like the ACLU who seek to expose government wrongdoing.
The most significant thing about this legal face-off is not the content of the document, but the government’s unprecedented effort to suppress it. No official secrets act has yet been signed into law, and the grand jury’s subpoena power cannot be used to create one.
If the government can enforce a subpoena in this way, it could just as easily have subpoenaed the Pentagon Papers from The New York Times and The Washington Post. The effect of the subpoena is no different than a prior restraint and it is equally unconstitutional.
In the landmark Pentagon Papers case, the Supreme Court said that the government cannot seek to bar newspapers from publishing even classified documents unless the information would cause “direct, immediate and irreparable harm to our Nation and its people.”
While release of the document in this case might be mildly embarrassing to the government, our possession of it is legal and its release could in no way threaten national security. To the contrary, the designation of the document as “Secret” “appears to be a striking example of the Bush administration’s rampant use of claims of “state secrecy” and overclassification of documents and information to hide its actions.
As we note in our brief, many of the most important news articles of the past year (such as those concerning NSA eavesdropping, rendition of foreign prisoners of our nation to other nations, Defense Secretary Rumsfeld’s views on the deteriorating situation in Iraq, National Security Advisor Hadley’s assessment of Iraqi Prime Minister Maliki, and the report on the Iraq insurgency’s funding sources) have been based on classified documents leaked to reporters, which could not be prepared and published as they have been were the government allowed to use subpoenas to confiscate "any and all" copies of classified documents it learns are in the hands of journalists and other public advocates and critics.

The ACLU is no stranger to the government’s use of such tactics to try to silence their critics. You can rest assured that even with the full weight of the federal government pressing down on us, we will act with courage and conviction in the days ahead.

the "ruling" party. They have it too good right now with getting their way most of the time.

Moral party they are not! Honest party they are not! Small government they are not!
No more taxes, yeah only if you are rich and can hand them bundles of money for campains and such.

The Burning Times - Are they truely over?

The Burning Times Aren't Over

I now know how the women of the Burning Times felt being dragged from their
homes in the middle of the night and tortured. I wasn't dragged from my home nor
was I physically tortured, but I was kidnapped and emotionally tortured by the
Traverse City Police Department and the Grand Traverse Sheriff Department of
Michigan.
After working a ten hour shift at Normic Industries that started at 3:30 pm
Tuesday October 17th and ending 2 am on the 18th, I was driving home on South
Airport Road. A few minutes after I turned off Park Drive on to South Airport, a
car drove up very close behind me. The headlights were lighting the interior of
my car and it was making me very uncomfortable because it simply wasn't safe. If
I suddenly had to stop, the other car would have rear-ended me. I turned on my
signal and moved into the left lane. The car advanced and I saw it was a police
car. I thought he was in a hurry and would pass. Instead, he turned his flashers
on. Confused, I turned on my signal and pulled over back in to the right lane,
then off to the side of the road, turning off my car and rolling down the
window. The officer walked up and I asked "What? What did I do?"
He asked me for my driver's license and registration.
I told him it was in my purse and pointed to the backseat.
He told me to get it, so I started opening the door. He got angry and slammed it
shut. He demanded that I get it by reaching around the other way. There was no
way I could reach it. He yanked open the door and ordered me to get out and go
to the back of my car. I did what I was told, asking what did I do. He refused
to answer. Moments later, he walked around riffling through my purse. He asked
me if I had anything sharp that would cut him or a weapon. I have a small atheme
that I carry for when I do ritual in the woods. It's a set of two knives--two
inches and one inch. Since most people don't know what an athame is, I called
them knives. I bought them on Ebay for 99 cents. He dug to the bottom of the
outside pocket and found them. He again looked through the main pocket, then
gave me my purse back and demanded I give him my license and registration. I
asked him to hold his flashlight over my purse while I looked for them; it was
even a bigger mess than when I gave it to him. After I gave him the forms, I was
handcuff and put in the back of the squad car. I kept asking why and neither
officer would answer me. I asked to talk to a supervisor and was told he knew,
but he was too busy to talk to me. Where the second officer came from I don't
know. I was so overhelmed, I didn't see if there was a second car. They searched
my car without my permission and arranged to have my car towed. They took my
keys and drove me to the jail. The handcuffs were so tightened they make my
hands numb. Wednesday I woke up with my right wrist hurt and swollen.
After we got to the jail, I was informed that my car was swerving and that is
why I was stopped. They arrested me because of my carrying a concealed weapon. I
was totally amazed. They took off the handcuffs and I was processed. They took
all my jewelry, including my pentacle necklace, and I was searched. During the
processing, I was searched twice more, which I didn't understand. Except for
going to the bathroom, I was always in their sight, so why would they
continually have to search me? Another person was being given a breathalyzer
test. I asked to be given one as well. I wanted it as evidence that was sober
and I had never done it before. I asked to talk to a supervisor and again was
denied. I asked for an attorney and was denied. They placed me in a hallway.
There was a payphone, but I didn't know who to call and I no longer had any
money. The longer I waited, the more nervous, I became. Stress is the main
trigger for my asthma. As the attack started, I asked for my inhaler; they
refused to give it to me. It turned into a major attack to the point of throwing
up and peeing on myself. An officer walked in and told me to stop making myself
sick. I told him the best that I could that I have asthma and needed my inhaler.
A few minutes later, he allowed me to use it, but it took a little while before
I was able to talk. During that time a dark haired officer with a mustache, who
claimed he was a supervisor came it. I told him that I could talk yet and to
come back in a few minutes. He never came back, but another one did. He said he

go without having to pay a bond. I told him about my asthma, allergies, and
hypoglycemia. He said he would make sure that I had access to my inhaler and
given something to eat. I told him I would be missing two dozes of my allergy
medication because I didn't carry them with me. There was nothing he could do. I
asked for an attorney and why my rights hadn't been read to me. He said my
rights didn't have to be read to me because they hadn't asked about the knife,
but ignored my request for an attorney. Before he left, he again said he didn't
understand why I was arrested and was sorry that he couldn't help.
Later I was put into a holding room and bagged lunch with two sandwiches,
cookie, juice and an apple were given to me. The juice was high in sugar so it
helped bring my blood sugar left back up. The sandwich tasted strange and the
bread was all dry. It made me sick. I forced myself to eat half of it because I
needed to eat and nibbled on the stale cookie. It was so bad I didn't know what
kind it was. I rationed out the juice to keep my blood sugar up. For the rest of
the night, I sat on the mattress and walked the parade of people. Every few
hours my chest would start to get tight and I would ask for my inhaler. It was
hard to get their attention, but eventually it would be provided. Each time the
officers were getting nastier about it. Breakfast was served to the other
inmates but I didn't receive any, nor was I asked if I wanted any.
There weren't any clocks so I lost track of time. Eventually I was let out to
talk to the "magistrate"--the woman who set my bail. I tried to tell her my
side; she wouldn't listen. No one would. She was more interested in my income
and what property I owned, than finding out what my history was. I tried to tell
her that I had never been arrested; like everyone else, she ignored me. She told
me I was to go before the judge at 2pm. My bond was set at five thousand dollars
with ten percent down. The only person I could think to call who would have
access to that kind of money was my employer. I called him and he said he would
see what he could do. Later, I was able to use the phone twice more to get bond.
My sister-in-law wasn't home; my credit card wouldn't increase my limit. I
didn't know what I was going to do.

most of the morning, I sat with my back against the wall, crying. Lunch was
served, but by that time I had waited to long to eat. Looking at it make me feel
nauseous, eating would only make me vomit. Instead, I curled back up in my

refused, but they gave it to me and told me it was the last time. Another
officer mentioned that they should send me to the nurse to be checked out.

to appear before the judge at 2pm. I was already in enough trouble already; I
didn't need more by being late. The officers told me not to worry about it; the
paperwork wasn't filled out yet, but it would be soon. There was an announcement
made for something at three o'clock. I again told an officer about the 2 pm
appointment, he told me the paperwork still wasn't ready. Later I asked again
about the time, the officer said it was nearly four. Another person and I would
be arranged before five. The was a problem with the transfer of a person and
there was chaos for about 10-15 minutes. The officers had a good time beating up
a young man who was being difficult. They laughed and joked about how they
wanted to punch him bloody. After things had calmed down, my court appearance
had been pushed back to Thursday at 9:45 am but my bond had been posted. They
were just waiting to get the receipt. After dinner had been service, I was
finally let out of the cell and my paperwork processed. They had taken all the
cash I had on hand and deducted cost of my stay, returning the rest in a check.
They wouldn't give me copies of anything bond the receipt of my bond being paid
and the check. They allowed me to use the phone. I called my employer to tell
him that I had been released. He told me that he had tried to pay the bond
earlier, but was told that I would be arraigned at two and that it would be
reduced. When he called before three and he found out that I hadn't been, he
made arrangements to pay it before 4. I wasn't released until after 5pm. It was
too late to contact an attorney. By the time, the cab picked me up and the tow
driver returned to the lot, it was after 6:30pm. Neither of them would accept a
check and I ended up going over my limit on my credit card in order to get
myself and my car home.
On Wednesday, I arrived at the courthouse at 9:30. I asked where I need to be
and for my paperwork. I was told I didn't need any and was directed to the
courtroom. While I was waiting, I talked to a man who also had been in jail at
the same time. He heard the officers joking that my paperwork had been ready for
a while, but since I had been a pain they were going to teach me a lesson. It
was after 11:30 before I was called before the judge. He finally read me my
rights and gave me a phone number to call the next day to get an attorney. I
told him I had never been arrested before and he agreed to give me back the ten
percent my employer paid. I was able to leave.
I was cooperative from the beginning and through the whole ordeal. I keep asking
why, because I wasn't being given answers. The couple of times in the past, when
I had been stopped the first words the officer said was did you know you were
speeding. The arresting officer wouldn't tell me anything. It was as if he was
looking for a reason to arrest me and wouldn't stop until he found one. I didn't
know him and don't know why he would want to hurt me. I lost two days of work,
cost me money I couldn't afford, and has made me physically ill. I learned we do
not have as many rights as we think we do. You can be pulled over and arrested
without being told why. The officer and his co-workers refused to give me his
name or give me a copy of the police report. You don't have to be read your
rights, given access to an attorney, or receive medical attention. You can be
bullied and mocked by the people who are suppose to protect you; if you ask
questions you are considered a troublemaker and you are detained longer. I
always thought the police were to protect the public, but they are the ones the
public needs protection from.

Since Shrub and his ette's have subverted the government for their own purposes these abuses of our civil rights happen more often and harsher, each time those who are supposed to protect us get away with things like this.

These things are not going away they are getting worse. They will keep getting worse until we can get those in power who are stealing our rights out of their offices!

I think their time has come and gone. It serves no purpose to keep people like them in office when harm gets done.
Let alone the deficit that they have put our country in especially with the ill timed war with Iraq. They forget the main target and go off on tangents!
I am afraid of what will happen with N. Korea as Shrub and his ettes would not think of the harm of a 3 or 4 fronted war.
I'm sure they have forgotten that's what did Hitler's war in.
When one forgets the lessons of the past they are doomed to repeat them. I really do see how they are doomed.

Republican Congressman Donald "Buz" Lukens was found guilty of having sex with a minor and sentenced to one month in jail.
Republican fundraiser Richard A. Delgaudio was found guilty of child porn charges.
Republican activist Mark A. Grethen convicted on six counts of sex crimes involving children.
Republican activist Randal David Ankeney pleaded guilty to attempted sexual assault on a child.

Boycott My Friend Flicka Movie
My name is Roland Windsor Vincent. I'm an attorney and I own and love
horses.
Last year I was an extra on the set of the Fox Films' shoot of Flicka,
and witnessed the cruel use of horses in what is known as a "Wild Horse
Race." Wranglers chase frightened horses around a ring, and try to drag
them down and mount them. The horses are terrified, and in the case I
witnessed one was tripped on its rope, kicked in the head, and died an
agonizing death.
There was absolutely no justification for subjecting horses to this
inhumane treatment, except to shoot a sensational scene to make money
for Fox. This was the second horse to die at the hands of Fox in the
re-make of My Friend Flicka.

Just as disturbing was the fact that the film's star, Tim McGraw,
hasn't had the guts to even comment on the death of that poor horse. I
had been a big fan of Tim McGraw, and I'm sure many of us now are

When asked by journalist Viktoria Pearson of the Lahontan Valley News about the VA's refusal to approve the Pentacle, he addressed religious freedom issues raised by Roberta Stewart, a Fernley widow of a deceased soldier who has fought to have a Wiccan symbol placed on her husband's grave marker.
Currently, the U.S. Department of Veterans Affairs does not include the Wiccan symbol of the Pentacle on its list of approved religious emblems for headstones and grave markers.
Jack Carter commented on the VA's failure to approve the Pentacle for use on government issued plaques and other memorial markers for deceased Wiccan veterans by proclaiming "it ticks me off in my constitutional soul!"
The Governor of Nevada also commented on camera and said of Sgt. Patrick Stewart, "He died serving his country; I don't need any more information than that."

I hope the map
that I have tried to put as a part of this blog works.
I will be doing more rants, but I had to take a break as
I have been a bit overwhelmed by all the stupidity of
"our" fearbringer pres and his minions.
Now the house of Reps who it seems is not representing us at all
have put through a bill that disallows a person who brings suit
for religious freedom to get the cost paid by the government
or the loosing side.
That will cut back on those who have cause to stand up to the
"religious right" (NOT) to have a lawyer who is doing probono
work or have lots of money themselves to stand up for freedom from
orgainsed religion(read Falwell, et al..)and freedom of speach.

are pushing for a theocrasy.
Has anyone been paying attention?

I am a mixblood...
my history of family is Mohawk, Cree and various Europeans
Peoples.
I wonder how many of them would like their ancestors remains dug
up for study as the government here is trying yet again to do with
the remains of the Indiginious People here in the United States.
Instead of honoring the past and the people who were here before
the europeans got here they want to study the bones of people
they think no longer have a tribe to complain when the remains
are dug up.
What they don't realize is that we are all related. The same things
that make up me, makes up them, the earth, the stars, even things that
are not alive as they would determine have some of the same chemical
components.

As a constituent and supporter of equal rights for all, I urge you to vote NO on the Marriage Protection Amendment (S.J. Res. 1) when it comes up for a vote on the Senate floor in June. This Amendment would enshrine discrimination into the Constitution and no Senator who has sworn to uphold the Constitution should support this effort. The Constitution enshrines democratic values of the United States of America and this Amendment contradicts these principles.
In fact, it flies in the face of our nation's commitment to liberty, justice, and freedom for all. This discriminatory amendment denies lesbian, gay, bisexual and transgender families the protections and fairness they deserve. Heterosexual married couples and their families are afforded more than 1,000 legal protections and economic benefits provided through state and federal law, benefits and protections that are currently inaccessible to committed same-sex couples.
Benefits of civil marriage include access to Social Security, Medicare, Family and Medical Leave, health care, disability, military and other government protections. Without the protections of marriage same-sex couples and their families are subjected to exclusion, discrimination and inequality. These are not the principles this country was founded upon! Please exercise your role as a strong defender of our Constitution and the 14th Amendment’s guarantee of equal protection under the law and vote against S.J. Res. 1.
This will be one of the most important civil rights votes of your Senate career and like all civil rights votes, you can rise above partisan politics and electoral posturing and declare our nation's dedication to equality.
Just because the bible says it's wrong is not a valid excuse to include hate and more seperation in this divided country. Besides the word homosexual did not exist in the time of the original bible being written. What is used now has been re-written many times to favor who ever is in power at the time. To top that little talked about fact is not everyone in this country is "Christian" and should not have to live under the contraints of that religion.Thank you for your careful examination of the proposed amendment and the legal and economic ramifications for your constituents and our nation if it is passed. Please vote against S.J. Res. 1.

I sent this early last year. I am finally getting back to sounding off in my blog about what I see hurting this country and it is closeminded people like the "good" Senator here.
His walk of faith is his and not mine, nor is it the same as many others in this state or country and yet he works to make everyone follow his walk in how he does things in the senate.
That is not seperation of church and state, that is not what the founding fathers wanted of this country.
Remember folks the European settlers who took the land here by force and faith were trying to excape the forced faith from their own country of birth.
Don't continue the stupidity. It's not the Faith in a creator(s)/Great Mystery that is wrong. It is forcing that one type of faith on others that is.

Heterosexual married couples and their families are afforded more than 1,000 legal protections and economic benefits provided through state and federal law, benefits and protections that are currently inaccessible to committed same-sex couples.
Benefits of civil marriage include access to Social Security, Medicare, Family and Medical Leave, health care, disability, military and other government protections. Without the protections of marriage same-sex couples and their families are subjected to exclusion, discrimination and inequality. These are not the principles this country was founded upon! Please exercise your role as a strong defender of our Constitution and the 14th Amendment’s guarantee of equal protection under the law and vote against S.J. Res. 1.
This will be one of the most important civil rights votes of your Senate career and like all civil rights votes, you can rise above partisan politics and electoral posturing and declare our nation's dedication to equality.
Just because the bible says it's wrong is not a valid excuse to include hate and more seperation in this divided country. Besides the word homosexual did not exist in the time of the original bible being written. What is used now has been re-written many times to favor who ever is in power at the time. To top that little talked about fact is not everyone in this country is "Christian" and should not have to live under the contraints of that religion.Thank you for your careful examination of the proposed amendment and the legal and economic ramifications for your constituents and our nation if it is passed. I sent this early last year. I am finally getting back to sounding off in my blog about what I see hurting this country and it is closeminded people like the "good" Senator here.
His walk of faith is his and not mine, nor is it the same as many others in this state or country and yet he works to make everyone follow his walk in how he does things in the senate.
That is not seperation of church and state, that is not what the founding fathers wanted of this country.
Remember folks the European settlers who took the land here by force and faith were trying to excape the forced faith from their own country of birth.
Don't continue the stupidity. It's not the Faith in a creator(s)/Great Mystery that is wrong. It is forcing that one type of faith on others that is.

Thanks to your thousands of calls and letters, we took a major step forward this week in the fight for Internet freedom.
A bipartisan majority on the House Judiciary Committee yesterday passed the "Internet Freedom and Nondiscrimination Act" -- a good bill that would use antitrust law to protect Network Neutrality. Special thanks to those of you who called the key members who cast the deciding votes.
The question before us is simple: Will the Internet remain in the hands of users and innovators? Or will a handful of telephone and cable companies determine which Web sites you see and which you don't? Yesterday's vote -- a milestone for our movement -- would have been unthinkable just three weeks ago. But we've shown once again that organized people can defeat powerful corporations.
Our opponents spent untold millions on high-priced lobbyists, slick ad campaigns and fake grassroots groups. But the voices of hundreds of thousands of citizens -- your voices -- made the difference.
The SavetheInternet.com Coalition led by Free Press now boasts nearly 700 groups that span the political spectrum, including MoveOn.org, the Christian Coalition, the Service Employees International Union (SEIU), Gun Owners of America, Consumers Union, and the American Library Association. Thousands of blogs have taken up our cause. Yesterday, the coalition's petition drive surpassed 750,000 signatures.
Our top priority is increasing the number of people who know about this threat to Internet freedom.
One thing you can do right now: Get five friends to join the fight
The struggle in Congress isn't over. The full House will take up the bipartisan Judiciary bill (H.R. 5417) -- as well as the massive rewrite of the Telecom Act -- after they return in June. The Senate is also considering major legislation that currently fails to protect Net Neutrality, though a bipartisan group of Senators are lining up behind the excellent Snowe-Dorgan bill (S. 2917).
Our work is not done. But momentum is on our side.

Patrick Stewart's Memorial Service this weekend!!
MEMORIAL DAY is the American holiday that remembers and honors US military war dead. This year it is on Monday, May 29.
Sgt. Patrick Stewart, a Nevada National Guardsman and a Wiccan, was killed in action by terrorists in Afghanistan on September 25, 2005.
He died in the service of the United States in Operation EnduringFreedom, also known as the War on Terrorism which the USA launched following terrorist attacks on America on September 11, 2001. Sgt. Patrick Stewart made the ultimate sacrifice and deserves the same respect and honor given the other war dead. He deserves to have his memorial plaque with his emblem of belief on it, the Pentacle, at this Memorial Day, the first after his death. More about Sgt. Thus far, the US Department of Veterans Affairs (VA) has failed to give Sgt. Stewart the honor that he deserves. Despite repeated requests to approve the Pentacle over the past 9 years, the VA still has not approved the Pentacle for inclusion on government-issued memorial markers, plaques, and headstones for deceased veterans. Because the VA has still not approved the Pentacle, Roberta Stewart, Sgt. Stewart's widow, is holding a special Memorial Day service to honor him, to memorialize deceased veterans of all religions, and to issue a public call to hold the VA accountable for upholding the US Constitution by providing equal treatment for all the religions of deceased veterans.
